EAD and unemployment benefits

I am the primary I485 applicant. Both me and my spouse are working on EAD. My spouse may go through a layoff due to budget constraints in the company.

Is my spouse eligible for unemployment benefits?

In NJ, UI benefits can be collected on EAD. I am not sure about other states.

I learned it from my company after they lay off me.

Eventhough some states let you claim the unemployment benefits, I suggest you to check with your attorney about that. Because it may jeopordise your 485 application. Eventhough your spouse is not primary, her application will be looked as an independent.
