EAD and Part Time Job

I have a quick question. (I hope). If I get a part time job on my EAD, say for sake of argument delivering pizzas, do I have to switch my regular full-time job from an H1-B to the EAD also?

yes!

(as soon as you have used EAD, your H-1 becomes invalid, so you need to inform your H-1 sponsor and fill out a new I-9 form. It is said that this is jsut for the records, and INS does not know of this change - my 2 cents):D

I think you misunderstood, your friend might say when you are on h1 and if you use EAD, then your dependent will become adjustee from h4. So he might advise you to not use EAD if you don't needed.

But With use of EAD you can do part time job / full time or business if you want only catch is you need to be full time employee for employer who file your greencard or derivative sponsor of greencard (AC21). So basically your principle job would stay same job, which your green card file for. but you can work as much as you can beside first job. That's real benifit for EAD.

Consult your lawyer immidiately , becuase I understood this thing from my lawyer.

I had also always understood that the part-time job did not need to be related to the duties performed in the primary occupation. (Under which the green card was being processed).

Here's another question. If my wife, whose currently under an H4, uses her EAD when it arrives, does it affect my H1-B? (meaning I would have to then use my EAD instead of H1-B at my primary employer)

Nop, you can maintain h1b as long you want.

From I-485, although she is derivative adjustee by you. her application is seperate. So if she use EAD/ AP it doesn't affect your h1b status. (but if you use EAD then she loose her h4 status becuase h4 is only depend on h1, and by using EAD you change your status from non-immigrant h1 to possible immigrant in waiting i.e. adjustee, Although that's also valid staus but it's not non-immigrant status.

Better consult your lawyer for confirmation.
