EAD and Parent's Visitor Visa-pls respond

Hi guys.
Quick question

My visa status- Adjustment of Status(I485) is pending and am working on EAD. My H1B has expired.

1)I am planning to bring parents for a visit. Would my pending AOS status will have any negative impact on the the visitor visa application for my parents.


2)My EAD is about to expire in April end. And I have already applied for the renewal in early Jan. WOuld this have any impact.


I have been told by my lawyer that "pending" AOS might give the impression that they are also trying to migrate or something. What do you guys think. Should I be concerned because my AOS is pending while applying for Visitor Visa fro parents?

Please respond. Any one there who invited their parent to visit here in US while they were on EAD and 485 Pending?

There should not be any problem. I sent papers for my mother-in-law to visit. I am on AOS and working on EAD. I send my EAD and my wife's EAD even though she isn't working along with 1-134 and other financial papers and my mother-in-law got 10 year multiple entry visa.

However that was in Sept. 2002. I am now hearing that in addition to these papers you need to or rather your parents need to submit your original birth certificate when the child is calling parents for visit, if not available then a non-availability certificate from the civic authorities (just as we had to for filing 1-485). This is something I hear the consulates have been asking recently.

I am also in same boat, my stamped visa on my passport expired in July 02.
I do have an extension, but I had sent photocopies for me and my wife's AOS and EAD.
My wife's parents got a 10 yr multi entry on their 2nd attempt
around mid-Jan.
I had sent my wife's original birth cert and my father-in-law told me some people got rejected because they didn't have the birth
certificate. ( defies logic though , since the same information is also on the passport).

I have one more question


It says you have to send the copy of passport for the H1B validatity. Since I dont have avalida H1 Do I need to sedn the passport. OR EAD is good enough.

Where does it say that you need to send the passport for H1 validity ? I think it is up to you what doucments/papers you want to send that will convince the consular. I didn't send my passport copy, only EAD copy. I sent my wife's passport copy in order to prove mother-daughter relationship since parents name are on it.

I can send you a list of what papers I sent along with a template letter to the consular if that will help you, if you give me your email ID.

During her stay with us in the U.S., I will support her boarding, lodging and any financial necessities as well as sponsor her round trip travel for the purpose of her visit. Please find included with this letter all the required documents necessary for her to obtain the visa.

The documents included are as follows :

1. Form I-134, Notarized Affidavit of support.
2. Letter of employment in duplicate verifying salary, position and employment.
3. Copy of my most recent bi-monthly payslips.
4. Letter in duplicate from Washington Mutual Bank detailing my checking account.
5. Letter and with a copy from Comerica Bank detailing my savings account.
6. Copy of my Employment Authorization Document.
7. Copy of my I-94 cards.
8. Copies of pages of my spouse’s passport verifying her mother name
9. Copy of my spouse’s I-94 cards.

I would appreciate you doing the needful in issuing her a visa to visit the U.S.

Hello Ooty,

A couple of weeks back I sent papers for my in-laws visa.
I'm on AOS and my H1B was expired in december.

If your H1B is expired, attach your copy of your EAD card and the receipt of your I-485. Give the full passport pages but do not worry about your your expired H1b visa on it. Because we just got it. That does not tell the officer the visitor is trying to immigrate. If the officer thinks that way then no GC holder can bring their parents.
