EAD and H4 ....

Hi

My wife is on OPT now. The OPT expires Jan 2005 end. I am on H1B and also got my EAD for me and my wife. My I140 is pending so I am thinking of using until I140 is approved.

If my I140 is not approved by Jan 2005, I am thinking of applying for my wife's H4. In this case, does she have to go out of the country to get onto H4 at the end of the OPT ?

I am sure you would get your I140 by then, even otherwise she can start working on the EAD(based on your work) after Jan 2005. If she is going to be in US, then she doesnt need a stamp, but officially she needs to get her H4 stamped if she wants to travel back to US.

If she has an approval notice of H4, that should be fine to stay legally.
