EAD and H1B confusion!!!!!

Hello Everyone,

I am on H1B visa. My husband has filled our (I-140/I-485/I-131/I-1765). My questions are:

- I got my EAD, my question is if I use my EAD, what happened with my H1B visa, is it gone?

- If I donot use my EAD, can I continue working on my H1B visa?

Your guidance will allow me to follow the right path.

Hi Snifks,

If you use the EAD, your H1b will be invalid. If you don't, then you can still continue to work on your H1b, but be aware that you will have to maintain your H1 status.
 
and just to add to this.......

if u come travel and come back and use ur AP instead of ur H-1B, ur H1-B is invalid and now u will have to work on EAD.

better to maintain H status while u wait, and work and travel on that, cuz u get three year extensions if u get stuck in name check or something, and for EAD u file every year

The above statement is not true. If you travel on AP you will still maintain your H1-B status. H1-B becomes invalid only if you use EAD.

i could be wrong, but i am almost certain that it is true.

That is not correct. You can enter on AP and maintain H1B if you continue to work for sponsoring employer.
