EAD and H1B 6 years limit

Hi,

I have I-140 cleared from previous employer in year 2000 and I wish to join them back and resume my GC. I can directly file for I-485.

My 6 years of H1B cap is getting over soon, in mid-march of 2005. But I have about 4 months of vacaction time in 6 years, which I can add to transferred H1. ( so it would be till July 2005)

If by any chance, INS has queries or something for I-485 and by end of new valid H1 time-limit, I do not receive EAD, does it create problems ?

Any other issues to be aware about ?

I want to decide soon. So any inputs would be greatly appreciated.

Same boat

I am in the same exact situation and I was able to land a position with my previous employer and started the I485 process. I also applied for EAD and AP for me and my wife. We recived the EAD but not yet for the AP. My H1 will expire in April and my lawyer told me no need to renew it. Also, you can file for I485 within 6 months of the expiration of your H1 so even if you H1 expired, you have 6 months to get the job and file for 485..

That is the info I recieved from my Lawyer..
