Hi - Recently applied for 485 , EAD & AP .

VSC , RD - June 11th , ND - June 19th .

1) When can i expect my EAD at the 'latest' ?

2) If needed to switch employer , when i can i do so without my process getting affected in any way ?

3) Lastly , if i do switch , can i work as an independent contractor already or will have to wait till i actually get the card ?

Any help will be HIGHLY appreciated . Current project ending SOON.

Thanks a bunch,

1. Nobody knows for sure, but if you don't hear anything from VSC and there is no RFE for your EAD, you can apply for an EAD from a local BCIS.

3. Wait till you get the actual card.

Don't shift employer till your I140 is approved (it is taking almost an year now). So you will have plenty of time to get answers for the rest of your questions. EAD may take 3 to 4 months for approval.

six months

then wait for six months ..if you have filed for 485 on an approved 140, it is safe to wait till six months! After that even if your employer were to withdraw your 140, it wont affect you! (murthy.com has many such cases)

6 months after filing I485, you will be a free bird if your I140 is approved and you have a EAD. You can work as independent contractor, work on W2 etc.

Based on my experience and opinion,

EAD processing is taking about 2 months at VSC on an <emp>average</emp>.

Under the new laws, one has to wait for at least 6 months post I-485 application before switching employers.

Talk to a competent lawyer about options for self-employment during the excruciating wait for the final approval.

you can take the new job after 6 months of 485 filing if your 140 and 765 has been approved. But I saw few of uor friends posting messages that thier old employer has withdrawn the 140.

Do more research on that. you got ample amount of time to decide.
