EAD and AC21 quick question

Gurus,

Quick question. I will be eligible for AC21 on Feb 1, 2008. I was planning to use EAD and move to another company if I get a better offer. Either ways I am able to port the I-140 priority date after 180 days (and pending I-485 after 180 days) using AC21. My question is if I get stuck in FBI name check, and my EAD expires in Sept 2008, will I have trouble renewing the EAD card ?
I know H1 is the safest way to go, but employers dont want to deal with H1 paperwork mess at all. Its hard to find a sponsoring employer (one that gives you a fair deal on salary as well) :D

Is there any correlation between EAD renewal and FBI name check stuck status ?

Thanks!

>>> Nope...

Renewing EAD no trouble.....If you use AC21 - the only harm is the usual -
probably if your employer revokes your I-140....then you may possibly get a NOID (Notice of Intent to Deny) for your I-485....and if you do not reply promptly it may get denied....then you may have to file an MOTR.....and stay out of job while your I-485 gets re-opened...

Thanks for the info Banta !
If you use AC21 and file in the papers with USCIS (job offer, 485 receipt, and AC21 documentation), then chances are either we get NOID (if I-140 is revoked) or EVL (employment verification letter). If you respond with the EVL and AC21 documentation, you should be ok, right ?

[ I have always religiously recommended everyone to change from company lawyer to your OWN lawyer after leaving the company after 180 days, so that RFE is taken care of ]

So do I have all bases covered ? or is there anything that I am missing ?

Thanks!!
