EAD after NIW I140 RFE

I140/I485/I765 Rd is 6/20/05.
I140 RFE is 08/07/05.
90 days has passed since I filed I485 and I didn't receive my EAD. Then I walked in the local office today to get my interim EAD. The officer said since the I140 got RFE, I have to wait another 90 days after I submit the evidence for 140. I was so angry and confused. I never heard this rule before. Am I not entilted to get an interim EAD because of I140 RFE?

Ideally EAD is attached to I-485. It should not have any relation wih I-140 or its RFE. If officer is saying that may be he will also have different opinion next time when you see him. I have seen such change of opinion......
 
I still don't get it

This morning I walked in and they said the same thing: since I140 was RFE, I485 was on hold and I can't get an interim EAD. Everything is based on I140. It's how it works. What should I do now? By the way, my local office is in San Francisco.
