EAD after I-824 filed?

I have indicated AOS on my I140 application. After I-140 approved I have applied for I-824 for CP (it’s long time since filed but not yet approved)

Is it possible for me to apply for EAD since my I-140 is approved?

From your question it wasn't very clear. Did you file for AOS initially and then file I-824 for AC-140/ change to CP? Or never filed fo AOS at all and only opted for CP after 140 approval?

You can only file for an EAD on the basis of a pending AOS only. If you have filed for AOS and then filed the I-824 as above, as long as the I-824 is not adjudicated, you are on-record as an AOS applicant. You can apply for the EAD. Hope this helps.

EAD after I-824

No I didn't file AOS at all after my I-140 approved.

When I filed I-140, I mentioned as an AOS option (I couldn't apply I140 and I485 at same time cause this rule was not there at the time I applied for I140). But after my I-140 got approved filed for an I-824 (for CP, Mumbai) as I was NOT sure I will be in US.

My I-824 is still pending for more than a year. So based on above circumstances am I eligible to file for EAD?
