EAD & Advance Parole related question

Hi friends,

I never changed my employer and recently, I got my H1 extension in Jul'03. My prev. visa ended on 18th Oct'03. I also had my EAD and Advance parole while I was on H1 visa.

Last time on 4th Oct'03, when I went to India, I had my H1-B visa valid upto 18th Oct'03. But, when I returned back on 10th Nov'03, I used Advance Parole. At that time, I did ot have my new H1 visa stamped on my passport.

I never used my EAD even though I had one. I was on always on H1.

Questions:

1. Will this affect my H1 or Greencard process in any way? I am yet to have my passport stamped with H1 visa.

2. Also, as I used my adv.parole once, do I need to renew advance parole again?

3. Do I need to renew my EAD also? If I do not renew it, can I apply for it again in future if I feel job insecurity with my present employer?

Thanks in Adv.

That confuses the heck out of me! :)

You may also want to try posting your question elsewhere while waiting for responses here...

Probably the largest immigration forum is "news:alt.visa.us.marriage-based" (if you don't have a newsreader, you can also access it via web browser at http://snipurl.com/4bcz which is the same as http://groups.google.com/groups?hl=en&lr=&ie=UTF-8&oe=UTF-8&group=alt.visa.us.marriage-based). There's a lot of experience there, including an immigration lawyer who often responds.

You can usually get quite good advice on http://forums.about.com/ab-immigration/messages/.

There's a US immigration lawyer who responds to posts here: http://chat.lawinfo.com/forum.cfm?FID=1023 .

IM lawyers often respond here: http://forum.freeadvice.com/forumdisplay.php?s=&forumid=9 .

I got some quite decent free advice here: http://www.visalaw.com/chatlive.htm . (It's really not a "chat", it sends an email containing your question).

Be aware that often a lawyer's response will be "this is too complicated and you need to *hire* a lawyer". That can be a quite legitimate response. You can find a lawyer who will give you a consultation through these folks:

http://www.aila.org/

That is the professional organization for immigration lawyers, and they will refer you to someone who will charge no more than $100 for a half-hour consultation.

(Caveat: A query to the AILA about the level of experience of their referred lawyers resulted in this reply: "Many of our members are new lawyers, so in that sense you aren't guaranteed years of experience in immigration law with one of our members. Still, a lawyer is not likely to pay the required fees to join AILA unless they are serious about practicing immigration law. AILA membership doesn't confer any special certifications, so the fact that membership is strictly voluntary might indicate that our members are dedicated to keeping up to date with changes in immigration law." Because *any* lawyer can join the AILA, you could possibly be referred to an immigration lawyer "in training". I recommend interviewing your AILA referral for their level of appropriate experience just as carefully as any other referral you come up with.)

Remote paid consultations are also possible...

At http://www.visacentral.net/ .

At http://www.visacentral.net/contact.html .

Note that I'm merely mentioning all of the above as possible sources. You're on your own in judging the quality of the answers you get. (The only exception is that I can say I liked the telephone consultation I got from http://www.visacentral.net/ .

Good luck,
Joe
