EAD about to expire

Guru's:

EB3, I-140 approved, concurrent. First EAD set to expire on June 18th. I have taken a permanent offer and the employer is saying I can't work from June 19th onwards until I get my EAD renewed. Applied for renewal with ND of April 9th. Current processing date is March 10th. I have the reciept notice for EAD renewal and I-140 approval notice. What are my options? H1B expired on March 30th, 2004. Didn't renew H1B.

cant you give them the EAD renewal reciept?? find out if they will accept that...
 
Your employer is right. You will have to sit home till 90 days are over to get iEAD or you get EAD approved(whichever comes first).

i didn't know they (USCIS) added new month called Jube :D anyway yep you have to wait for 90 days for Iead which i think is approximately July 9 th.

You can't work with receipt. ask emplyer to wait untill July 15 th to be safe side and then go get your IEAD (make sure you don't need an appointment cause in some cities you need to take appoitment and in some you can walk in.do find out with your local CIS center ) if not you just have to wait for EAD.
 
Jharkhandi..Thank you for the correction.. only a few days for 90 days for him to complete ..so i guess the only way is to talk to the employer and get a iead and start...

No problem.

Here is what will happen if employer allows to work and pay - labor dept will chase down employer and USCIS will do the same to GC applicant. One is not supposed to work without EAD/iEAD approval in hand nor is employer supposed to allow a person to do so.
 
Thank you all for the replies. I talked to my attorney and he says that he is going to send me some documentation which I have to show it to the HR people. He says that I can work for 240 days after my EAD expires. I am not sure what he is talking about but I am waiting for his documents.

Ask for the law - it will be nice to know what he is talking about! Is he confusing with 240 days rule for H1b receipt by any chance?

If you are not sure what he is telling you - you do not fall in trap - you will be loosing most - your employer will just pay a one time penalty that is all.
 
Sorry folks no updates. As usual my attorney is slow in sending the information when you need that inormation. Jharkhandi, I have two questions, when can I go to the local office and apply for the interim EAD? I live in Northern Virginia, so which office should I go?

Did u ever get a reply from your lawyer on the 240-day rule about the EAD. I am in a fix as my wife is about to get a job but her EAD renewal has not arrived. Its only been a month so I cant even get the iEAD. Please let me know if your lawyer ever got back to you.
