Hi,
Does anyone know which one do we need to take into account for EAD 90 day period. Is it Receipt Date(RD) or Notice Date(ND).

Does the 90 day clock start from RD or ND?

Thanks

count 90 day clock from the RD - it should not be much of a difference though.

OK, so I am confused. I asked a smilar question in another threadhttp://www.immigrationportal.com/showthread.php?t=159801, and was told that the 90-day period began on the date ofthe letter from the USCIS acklnowleding the receipt of the application, which I assume is the ND. Is that not the case?

For my case, the dates on which the application was received by the USCIS office in Sacramento are nearly three weeks apart: they received the letter on the 25th of October, but the receipt letter is dated the 19th of November.

Could somebody give me the definitive answer (if such as thing exists) on which is the date for the beginning of the 90-day period?

90 day Clock according to the USCIS

Our EAD on a marriage based I-485 was received by the Sacramento Field office on January 2nd, but we got a notice of reciept dated February 28. I called the National Service Center and they told me the clock starts on February 28. However, my lawyer said to take the green reciept notice with the Janaury 2nd date(for registered mail) at the 90 day mark and ask for an emergency EAD then.
