I thought that if your EAD expired it did not matter as long as your H1 is still current and you have applied for 485.? Is this accurate?

If you never filled out the form I-9 with "EAD" as a document that shows your right to work in the US *and* never used your Advanced Parole to enter the US then your status is still a "non-immigrant worker" and you can continue to use your H1-B as a basis for work authorization.hoping4miracle said:I thought that if your EAD expired it did not matter as long as your H1 is still current and you have applied for 485.? Because when you enter on your Advanced Parole you are PAROLED into the United States, not ADMITTED. Therefore if you use your AP to enter the US your status changes from a non-immigrant to a adjustment applicant (immigrant). Moreover, should you decide later-on to enter on your H1-B, INS might consider your I-485 application abandoned!CouldNotPost said:why the link to AP ?
Of course, it does. But you cannot have two statuses at once. You are either a non-immigrant worker (H1-B) or an adjustment applicant. Once you switch your status to adjustment applicant you cannot switch back without risking throwing away your adjustment application.CouldNotPost said:doesn't H1 permit dual-intent ?
