Hi Guys,

I need your help/suggestions.
Mine is an No 2001 RFE case, below are the details:

RD: Nov 2001
ND: Dec 2001
FP1:Apr 2002
AR-11:Aug 2002
Changed job (because of layoff) & joined a consulting company in Apr'03. Started working for the client company.
RFE: May 2003 (for employment letter, 2 months paystubs, and
taxrerurns). My consulting company provided me with all the
documents.
RFE RD:Jul 2003
AR-11 (2nd):Aug 2003
FP2: Nov 2003 (done)
FP3 received in Dec'2003, scheduled in Feb'2004

Now, I am waiting for my GC approval & 3rd EAD renewal
approval. The client company for which I am working
currently is offering me a full-time position. I am in confusion.
My question is:

Q. If I join the client company using the EAD, will there be any
issues in my GC process especially since, this will be my 2nd job
change using the EAD ? (Since I will be working for the same
client on full-time basis, the job duties and also the salary
remains the same). If I don't accept the full-time position
then I fear that the client company may end my contract.
Q. Is there any restriction on the number of job changes using
EAD ?

Your input is truely appreciated.

Thank you all.

Regards,

Sunnyk

There is no rule or regulation that you should only change the jobs once on EAD. As long as the job is same or similar and your 485 is pending for atleast 180 days, you can change the jobs invoking AC21.

No, you can are free to hold and change jobs with EAD work permit.

AC21 requires your be in same or similar field as per your approved Labor.
Its ok to change locations, salary requirement are same or higher(debateable). Will your client provide a W-2 ? or you going with corp to corp ?

Preferred is having employment on W-2 basis, from what I know it takes
up more taxes on W2 than being on corp to corp(which consulting companies like).

ar888 & vsc_babu,

Thank you very much for responding to my questions.

My I-485 has been pending for over 2 years now. So, I don't
think there should be any problem.

vsc_babu, my client is offering me a full-time position on W2 basis.

Thanks again.
