I have an E2 visa as does my wife and we both own 50% of the company. I would like to apply for an EAD but I note that on page 3 of the I-765 instructions, it says 'File your EAD application with evidence of your lawful status and evidence you are a spouse of a principal E-1/E-2, such as your I-94.
I take this to mean that as I am not currently a spouse of a principal (instead I am a principal investor) then I cannot currently apply. My questions are
1)what steps can I take to become a spouse of a 'principal' i.e complete a stock tranfer from me to her?
2) what percentage can I do to make it legitimate? i.e 51%/49% or 100%/0%
3) how do I notify the consular office who granted me an E2 visa as a principal investor and will they issue me a new E2 visa?
