Hi I am in H1B, expired couple days and applied for E2
business and everything is good, lawyer arranged all paperwork and application to California center with Premium processing .........

My all application came back in a week only asking me to go any US consulate of my choise

I am in US and this I dont understand my E2 is not approved and not denied only asking me to go any US consulate of my choise.

Can I just go to one in Texas and get my passport stamped if I am approved for E2 visa?

I thought that I will have some kind of paper saying approved or denied for E2, if I was approved then I will leave US and apply for visa in my home country for E2.

Am I mistaken somewhere?
Does some guru have an idea what is going on, I looked everywhere but there is no similar case?????

that kind of stupid things always happens to me, what is wrong I have no ideaa

Thanks for your help

It looks like your E2 application was approved. But maybe your attorney did not apply for a change of status so USCIS assumed that you would apply for the visa stamp abroad (most potential E2 visa holders get their visa stamp outside of the US). Just double check with your attorney. Unless the rules around E2 have changed that would be the only reason I can think of.

Sounds as if you applied a couple of days late for a change of status. Your status had expired and therefore there was no status to change. You need to leave the US to resume lawful status. USCIS could have granted the change of status as a matter of discretion but it appears they decided not to do so.

Just a guess but it is the best I can do without reviewing the material.

Hi

It appears the rules have changed.

L visa and E visa holders have to return to home country to get passport stamped

This is worry for many people who moved to the US buying a business on E visa.

As they have to return to home country, then they have problems as to whom they can trust to run the business in their absence.

All family members have to return, this means taking children out of school. This change in system makes no sence to me.

But until such times as we get our voices heard and acted upon, what choice do we have?
