E-3 In country extension - premium processing

Hi - about a month ago, my employer submitted an in-country E-3 extension (without premium processing). It has taken longer than expected so my employer is now thinking of re-filing using premium processing. My employer's attorney seems to think we need to get the USCIS receipt prior to re-filing, however the receipt is also taking a long time (although I note the initial check has been cashed).

Does anyone know if you are able to re-file without the initial USCIS receipt?

Your employer can certainly file a brand new E-3 extension with premium processing, without needing the receipt notice from the original one.

Only if they wish to upgrade the already pending E-3 extension to premium processing (as opposed to filing a brand new one) they would need the receipt notice. If they really want the receipt number, they can ask their attorney to call USCIS customer service so they can look it up (although if it's lost in a backlog at the lockbox somewhere, this strategy might not work).
