I formed a company in US, and I am in the process of transferring all my personal assets to the company. I thought about applying for B1/B2 or H1B, but after I asked about this in a couple of forums, a few people mentioned about possibility of applying for E visa. My understanding was that it requires a substantial amount of capital, but does it? Also there are number of different E visas including E-2, E-B1, E-B2 or E-B3. Is there any E visa that I can potentially apply for and obtain without having a substantial amount of capital?

Hi

The critera for an E visa is you must purchase a business for a substial sum, but there is not set figure

I have may friends who move to the US and the lowest amount that qualified for a five year E visa was $120,000.00

Check out www.expatsvoice.org If you want to live in the Florida area.

You can start a business from scratch but you will have to show a good business plan, lease on premisies, all sorts of commitments you will need an immigration attorney

Hi

You may be able to get company to sponser you for an H1B, also you maybe able to get company to submit I 140 for you and concurrently file I 485 for a green card.

It is very difficult to say as you only give limited information.

You do need to run this by an attorney

E2 Possibility

It sounds as though you may qualify for an E2 visa. If you plan to own and operate your own company, rather than work for someone else, this is probably the best route for you to go. Keep in mind that not all foreigners can apply for this visa, it only applies to citizens of certain countries. I usually recommend my clients invest at least $80k. It really depends on your country of citizenship and the type of of company you will open though. Let me know if you have any other questions. (info@thevisaexpert.com).
