DWI - B1/B2 Visa

Hi,
I’m a foreign alien (visitor) arrested in Hays county (San Marcos, Texas) in July for DWI and bailed out for $5000. I had an attorney who attended the court in my behalf as I don’t live in the US.
Few days ago, he told me that the prosecutor offered either 90 days jail or 45 days jail and pay $12k + court costs saying that me blood test result was too high (0.21) and the Field sobriety tests were not good.
I’m set for court on January 31, 2008. What can I do? Maybe hire another attorney??
Will they deport me after I serve jail?

If you don't appear in court, a warrant will be issued for your arrest. However, you appearing in court depends on you being able to get a visa to enter the U.S.A. I wonder what you will tell the consulate will be the purpose of your visit.

I would consult a very good Attorney quickly. And yes, if you do manage to get to the U.S. and you are incarcerated, you will be deported. The goal should be to reach a plea bargain for a much lesser charge.
