DV2011 vs EB2

Hi
I am the DV2011 winner and I have sent the DSP-122 to KCC. Now I have a question. Because my company is going to file EB2 (140 form) to USCIS for green card, will it conflict my DV2011 application? Is it OK to apply green card by both DV2011 and EB2?

I appreciate your help and answer!

I am assuming here that you will be doing Adj of Status.

Are you filing 140 along with 485 or just 140 alone?

If you only filing 140 by itself at this time, it does not matter. The I140 is for your company, which is the petitioner. You are just a beneficiary.

If you have a pending Employment based 485 and then you file DV based 485, most often USCIS likes to reconcile the 2 cases and may want to bring the files together to the local USCIS office.

Either way, I think you can have pending I-140 and file DV 485.

What is your CN? Good luck.

Hi Nybound

I really appreciate your insightful answer and comments.

Yes, I will do Adj of Status in USA.

I will only file 140.

Base on your suggestion, I would like to file I-140 for EB2 soon and file DV485 when my CN is current.

The reason, why I want to do this, is my high CN. My CN is AS2XXXX. The number may become current on July or Aug 2011 and I am worry I may not finish all the DV process before September 2011.

Thank you again!!
