Will I be barred from receiving the immigrant visa thru the DV2008 lottery while doing CP? I have been selected with a low case number (current Nov/08).
•I overstayed for 5 years a J-1 visa (no 2 years home country requirement) but left the USA Feb 1996 after graduating from university.
•I worked in the USA without authorization but with my own SS# (I paid and filed all my taxes) from 1990 thru 1996. I guess once I disclaim that I had a SS # they will find automatically that I used such number to work without authorization. Can I be denied the visa under this breach of law?
•I believe I did not disclaim my SS# when using form DS-156 when applying for a B1/B2 visa in 2002, which was issued without an interview. Will this be considered a misrepresentation? Should I mark this while completing the DS-230?
Do I have to disclaim the above issues while completing and sending the DS-230? Which questions? In case they deny the immigrant visa (before or during the interview??), they will let me know under what grounds? Are there reliefs available thru waivers? My parents, sisters and nephews are USA citizens and I do have an I-130 petition approved Dec/2006 (no current).
