DV Winner/Spouse (all family members in the us) wants a divorce

If a DV winner is having great difficulties with his spouse and threatens that he doesn't want to go to an interview when it is time to go (in the US.), what could be done in this situation? DV Winner is asking for divorce (DV interview will most likely take place within the next two months)

Can the winner's spouse go to an interview with the children and explain the situation? Originally, the DV winner's spouse filed a labor certification (I140) back in 1999 and was approved. Then I485 was stuck in review for many years now and the family was called on a few interviews for clarification.

Then the DV winner received notification that he won the green card lottery. The family submitted all necessary documents and DV application is now together with the original case.

Any advice on the correct course of action will be appreciated.
 
I think they only issue the green card to the original winner and then dependents. They might still be able to continue your EB application because technically those are 2 different applications. They have mine together as well becoz they wanted to compare the two. An attorney might be a lot more helpful on your options.
