My husband’s number is 2008EU00017XXX, he is on TN status, and I am on H1B, 7th year. My visa will expire on March 2008, I am in the process of LC approval (EB3, March 2005), and if I do not get it I can not extend my visa beyond March 2008. His TN is valid through February 2008. What should we do? Apply for CP? We have a few possible scenarios –
1) In case my LC gets through and I can stay in US, can my husband apply for new TN once when we sent DV lottery for CP? If he can, in this case we are both in US.
2) In case my LC is denied and I have to leave US, can I still go for an interview in CP? If my husband renews his TN visa, he can stay in US.
3) In case my LC is denied and my husband can not renew his TN visa, can we still go through CP for an interview? Based on his number that could be May-June 2008.
What are the possible problems in our case that we should be aware of?
