DV Selectee 2014 EU42XXX, but wife has J1 visa

I am in difficult situation. If someone has any idea or information, please share!!

My wife has J1 visa, I didnt take J2 visa and I am visiting her on simple tourist B1/B2 multivisa for some time already.
When I was submitting DV Lottery we werent married yet.
Now if I take my chance and decide to send documents to Kentucky center, how can I minimize the failure risk?
Maybe better I send documents as I am single now to Kentucky so not to harm my wife J1 visa status, and also not to harm my possibility of getting GreenCard? And then after some years re-register our marriage again and try to help my wife get GreenCard by our marriage?

Thanks in advance

Your wife needs to file a waiver of the 2-year requirement.

Thank you Tew, we also want to do that, but she has 2 more years until the end of her program..I dont know if she can file a waiver now or even until the time of possible interview...

Please read the AOS2014 Only thread entirely and then post questions if you have any.

If I were her I'd go ahead and file the waiver immediately since it takes time to process it. She should contact an immigration lawyer to make sure everything is ok. The good news is that your case number is quite high so there is time to obtain the waiver if USCIS works fast enough since your interview will likely be late in the fiscal year.

I concur with reading the thread on AOS.

I would not be that fast. Upon obtaining the waiver, one cannot extend DS2019 anymore. Consulting somebody like DSO or lawyer is advisable before taking any steps.

Thank you very much aos13, I have just read about it in the thread you mentioned!!

Yes talking to a lawyer is very important if you can do so. Even after getting a reply here about my AOS status, I called a distant family member who is an immigration lawyer and confirmed with her.
