DV 2010 - I just won! Consular interview

SADK2

I found out this week that I won! But alas, apparently my case number is super high. I called the KCC and they were very helpful. The rep said the person who had my case number last year didn't get their consular interview date until August (but they were notified in June). Now, this is just an estimate. This year I could get mine sooner but my question is this....

SHould I go for adjustment of status instead. My interview date could potentially be later than August.

Thank you in advance for your help :)

Congratulations. What's your region and what range is your CN #? I just got mine yesterday also and mine is super high too, so not sure what to do. My region is AF and my number is in the 70xxx range :(

I'm in US so I think I can do AOS. I'm in F1 status right now and never fallen out of status. I've heard CP might be faster but not sure how true that is.

Congrats!

Definitely not if you case becomes current that late.

What's the difference? I talked to an immigration lawyer and he seems to think it doesn't matter whether you do CP or AOS because either way you don't get scheduled for an interview until your number becomes current.

As far as I can tell it seems mine (70xxx) will never become current, so does it matter what route i choose to go? The risk with CP is that they will cancel my visa if I go home and i won't be able to come back. (My visa is expired but my I20 and I94 are current). Any thoughts/advise on this?

Processing time for AOS takes longer and it is likely that it is not finished before Sept. 30 when you start it in August.

My CN number is AF0005xxxx. I am currently on a H1B. If I don't get the Greencard at the interview in Nairobi, do I lose my HIB visa?!! Goodness that would be awful!

By the way thank you Tazmania and Muffin for the congrats and advice.

Congrats to you too, Muffin. It sounds like you should stick to CP. I had a family friend who went to Nairobi 2 years ago and he said they will more likely than not approve your greencard the very day of your interview.

Your CN# seems ok than muffins. You may get an interview next year somewhere in August. With this CN, it's advisable to do CP as the processing through AOS takes longer time. Looking at this year's current of over 64,000 in August, I hope you stand a better change of getting an interview.

I think your CN may or may not be current in September. I will not recommend you to continue the process if you value your studies in the US highly. It is very risky as such high numbers are rarely called for interview. You can still continue to try the lottery. Who knows, you may win again next year or in the near future. It's very hard for me to say this.

Hongera for winning!!! i will recommend that you go to nairobi, unlike f1 visa which is normally canceled prior to the interview, H1B allows dual intent (if my memory serves me well), even if they deny it you will fly back using your H!B.

Never read such a bullshit

ammeck09, SADK and Tazmania,

Thanks for your feedback. This sucks for me. I'm not 100% sure still why it is better for CP. Aren't the numbers on the visa bulletin the same whether AOS or CP?

At what point is it considered intent to immigrate if I submit for CP or AOS? Is it immediately I submit the first papers to KCC? Or is it when they call me for the interview?

I feel like I shouldn't let this chance go to waste but then I don't want to risk my F1 status because I'm transferring to my grad program in the Fall.

They are, but processing time for AOS is longer and can worst case take some month. If this happens with a CN current in August you are not able to finish the process before Sept. 30.

If all your papers are fine, there is nothing to worry with CP.

Thanks again Tazmania. My visa is expired but my I20 and 194 are current. So I'm a little worried about leaving the country. Also it looks like with my high number I will probably never become current and I'm worried they'll revoke my F1 because of showing intent to stay in the US. I'm almost worried that it's not worth pursuing. :(
