DV 2008 - AOS only

I just got married to my Australian wife. I am currently holding H1B visa. Never been out of status, and ALWAYS obey the law :) !

Few days after the marriage, we learned that she had won DV-2008 GC lottery. Her number, I assume, was pretty low (less than 1500). She is coming back to US with H4 (spouse) visa next month to live with me.

We thought it would be better to do AOS when she is here rather than doing CP back in Sydney.

I have read so many threads in this forum, and found many useful info. However, I think each situation is unique and might have different responses.

This is what we have done so far:

1. We called KCC and informed them about wanting to go with AOS path. The lady told us to contact USCIS to find out if we were eligible for AOS.

2. We called USCIS to assure that H4 and H1 were eligible for AOS. The answer was YES!!!!

3. Correct me if I am wrong, but from the instruction it was mentioned that I need to send payment to DOS for applicant + her spouse. From given site about the fees, is the total fees for ONE person as follow?

- Diversity Visa Lottery surcharge for immigrant visa application (per person applying as a result of the lottery program): $375.00

- Immigrant visa security surcharge, for all IV and DV applicants: $45.00

Total Fee per person = $420.00. Is this the correct amount?

4. When do we send this payment to DOS? Before or after we send our AOS application to USCIS (considering a situation where our visa number is available already)?

5. What is the lowest educational documentation needed as supporting documents? High school diploma? What if the person has not completed his high school diploma, but got his bachelor degree (and diploma)?

police certificate

Congratulations!
I have aquestion for you (or your wife) that may concern you as well. I lived in Australia for a year aftr I was 16. so that means I will need a police certificate from the Auzzy police for my interview. I am from south america living in the states. how can I go about obtaining that certificate from here?. does anyone have any ideas?
 
Click, thanks for the reply. About the police certificate, there has been different information I read from the Internet. Some explains that AOS DOES NOT need police certificate, but others DOES. I was looking form I-485 and didn't find anything about supplying police certificate.

Can you tell me why you had to supply such doc?

nacho2008's post is also might be a potential issue to my situation since I came to US when I was 23 years old.

Any thoughts?

I think you are right we do not need it and I was not asked for it (I am just beggining and learning the process) We still have time and if it is not too hard to get I though I might as well have it just in case. better safe than sorry and maybe not having one of those things might delay everything.
