Hi all,

I am Valerie. I received congratulation letter from Kentucky service center for DV 2007. It says that the interviews starting in october and a separate letter will be sent to notify the date. I had a two year residency requirement ending in October.
My question is : Do I have to waive it since it will be over by the time I go to my interview.
Or should I check "no" or " yes" for the question asking the two year rule...
I am really in need of your help....

Hi

I am also with J1 visa but mine expires in 2008. As far as I know it is necessary to apply for a J1 visa waiver , and you should do that as soon as possible.
BUT TO BE 101% SURE YOU CAN CALL THE CUSTOMER CERVICE , the USCIS number and ask to talk to an immigration officer and ask if it is necessary.
BUT AS FAR AS I KNOW YOU NEED TO APPLY FOR A WAIVER.
To apply for the waiver based on NO OBJECTION LETTER you need to call your countries embassy or go to there site and look for visas and the J1 visa waiver.
You better start working on this because time is running and you can not apply for the ADJUSTMENT OF STATUS without the J1 visa waiver.

If your residency requirement will be fullfilled in OCT 2006 then you will be fine. You need to show that you had spent 2 years in your country of normal residency after J1 Training finished at the time of interview.

Please read Department of State website for more clear and details.I would also encourage you to send an e mail to KCC and hopefully you will get a correct and swift response from them.

We are in a similar situation (slightly different because the 2 yr rule doesn't apply). My lawyer sent a letter to USCIS requesting official confirmation that we did not need to complete the 2 year residency. I can't remember exactly what it was called that she requested, but it was something slightly odd. They sent her back a letter confirming we didn't need to do it, and she included that in our application package.
If you're DV2007 you're unlikely to have an actual interview in October 2006 right? (I guess it depends how high your number is and when it will become current). But if your 2 yr rule expires in October it sounds like you're fine to me. (just my personal opinion though!)
