DV-2007 : Child expected after Sep cut off date

Hello all,

We are DV-2007 winners and we (husb/ wife) got our I-551's stamped and planning to leave to USA shortly.

Regarding child birth - my wife is preg and will probably give birth in Mar 2008. She wants to come back to her native country so that she gets support of her parents during the child birth.

What I understand is - If we enter USA now - we get our GCs. Then - if spouse leaves USA & gives birth in her native country (outside USA) in Mar 2008 -
1. What visa does the child return on?
2. How easy is it to get this visa?
3. Another question is - If we got the GC and stayed for more than 6 months outside USA - what are the repercussions ?

If your wife return before the child's birth, your newborn may not need any visa, (I am not sure at this point, I heard somwhere in this forum!, please ask other people and best to ask US Embassy)-BUT if your new born needs a visa then it may be easy or may not be-ask embassy.

If your wife give birth in USA your child will be a US citizen, then right after birth (say 2 weeks) your wife can go with the newborth with his/her own passport. Thats the best I belive!

Your wife can stay their up to one year without any permission .A reentry permit is needed for reentry for trips greater than one year but less than two years in duration.

If you stay more than six months but less than a year you won't need any re-entry permission however your days won't be counted towards citizenship (for example
you entered here in September 15, 2007 then you left on March 15 2008 and stayed more than six months outside USA then- from Sep15 to March15 -this six month will not be counted toward citizenship- you need to stay 2.5 years within five years to apply citizenship) BUT this six months will really not hurt your citizenship application.

M1rahim has a good point..Your spouse will give a birth in the US, your child will be automaticly US citizen that will bring to her/him more benefits.

If you insist on newbirth in your native country, if the child (younger then 2 y.o.) will return to US with one of his/her parents then child does not need visa. [I learned about that on this forum from the posting by LucyMo. If you want to be confident, it is better you will ask USCIS for confirmation before your spouse will go to her country ]
