DV 2007 -AOS Question

Hi All,

I am a DV 2007 winner, Case no. 2007AS000062XX. I want to do AOS. I send all the forms to KCC and they received it on August 14. But I didn't receive any acknowledgement letter yet. I am working in USA under h1b. My 6 yr stay in USA will expire middle of March, 2007. I am expecting that my number will be current on March(What is your opinion?). Now I have some questions:


1. When can I expect the acknowledgement letter from KCC.
2. How earlier I can apply for AOS before my number is current.
3. If my number is current on March and I submit all the AOS docs before my h1b expiration, then my status will be ok? What is the rule? I am very much worried about this.
4. When I will do Medical?
5. I didn't send the DV surcharge fee $375(This the amount, right?) to USCIS. Do I need to send it now? Do I need to send this fees receipt with AOS docs? Do I need to send original or photocopy?

I really appreciate if somebody can help me in this regard.

You would probably receive it soon. But if you know for sure they received your forms, you should be OK.

2. How earlier I can apply for AOS before my number is current.

If your number is current in March, then you would be able to see it in "April" visa bulletin, which comes out in February. I think you can send your AOS package in March.

3. If my number is current on March and I submit all the AOS docs before my h1b expiration, then my status will be ok? What is the rule? I am very much worried about this.

Yes. If your RD (Receipt Date) is before the expiration date of your visa, you should be fine. Once you have a pending I-485, you are in legal status.

4. When I will do Medical?

Medical should be done before you sent your package, so you can send the sealed envelope, that doctor will give you, with your package. You can do it 2-3 months in advance.

Yes, send the $375.00 now. You need to include the receipt with AOS docs. Send the original, keep the copy.
