DV-2006 experiences

we from West Africa, my wife as principal applicant and me as a beneficiaries.
we did our interview on april 25 2006 as CP in dakar- senegal. the consular officer a lady said
1- my wife is not qualify for the visa because her occupation is not accepted.

2- my finger print pop up on the screen showing I was arrested in USA.

my wife filed for job experience on DV application and she is a high school no diploma after she did associate degree in IT management in Senegal(we didn`t mentioned on dv aplication). she had 3 years of job experience 2 for sale agent for computer and IT material and 1 years as costumer representative for telecom companies in a call center.

me I graduated in montreal canada from 1998 to 2001 and used to travel to USA as B1 or B2 visa. on Jully 3rd 2000 I was involved in a fight in Maryland (night club) and i was arrested and realese next day. I went in court on 12 september 2000 and a Nolle Prosequi was entered (dismissed).

Then after a long discution with the consular officer we told her my wife had a associate degree but she didn`t have a high school diploma. she told to bring a copy and original of the associate degree and she gonna investigate by office in DC about my finger print or my arrest.

From that day i contact the District court of Maryland and i filed for Petition for Expungement of records form 4-504

we come back on 6th june at consular office to bring the original and copy of associate degree of my wife and they said they will contact us.

June 20 2006, i send email to consular office about our case and they respond me:

Dear Mr. xxxxx:

In order to proceed with your application, this office must confirm your eligibility for that visa. We will contact you if we need additional information or if we need to conduct an additional interview. Until we have completed this verification process, we cannot move forward with the visa application. As each case is unique, we ca not predict how long the verification process will take.

on July 16th 2006, I receive the order for expungement of police and court records from district court of Maryland by mail.

Now i think they doing security check or name check in DC and we are very anxious about 30 september.

Today I receive certificate of compliance
 
On what basis were you planning on qualifying for the DV?

- No qualifying job experience. You said you didn't mention the IT management experience.
- No High school diploma. This is a basic requirement. How did you think you wouldget approved without showing this?
- No assets mentioned
- No sponsor
- And the icing on the cake is that you didn't mention your arrest in the application. Withholding information is considered lying, and they can actually bar you simply for having an immoral character.

when my wife win the DV she didn`t receive yet her associate degree. then we mentioned high school no diploma with more than 2 years of job experience.

the day of interview the consular officer said that this type of job (sell representative and costumer representative) is not qualify. that way in the end we mentioned about my wife associate degree.

after the interview I went to online job database off US gouv then I found both job experience mentioned as qualify.

but we think to go on the consular officer way :

-to bring the associate degree
- wait for the result of washington investigation

I didn`t mention about my arrest because that was in 2000 and realy forgot about it and that was very minor.
 
Dear BIRS, since you did explain everything to the Consular Officer and she still asked you to go back with more evidence, to me that means she was willing to consider your case. She didn't deny you, she could have, you are lucky. So, take advantage of it and send in/take every further piece of evidence showing that you are not a criminal and that your wife's work experience is sufiicient by their standards. I don't know how you are going to do that, but I'm sure you can come up with something. Above all ADD the fact that the 30 September is fast approaching.

thank you so much Barbara, that`s what I wanna read.

right now district court of maryland send me all the document I need.

- order of expungement of police record and court records
- certificate of compliance of this order

Like they reponded to me , they are still doing a verification process (background check ) about me.
if it done they will contact us.

My question is : if background check is not done before sept 30. Are there willing to process my wife case who is the principal

the question about whether they could give your wife the GC in case your background check doen not come back before 30 Sept. is a crucial one that some of us are also asking.

I'm doing AOS and yes, I am the principal applicant and can be adjudicated separately (my husband is waiting for background check). But this is how they do it here. When you do a CP they may like to follow different guidelines. I don't know.

Thing is: your wife is the winner, if the work experience issue is resolved then she must ask for an adjudication even if they cannot give you a result. This way you will be able to re-apply as a family member. It will take a long time but it can be done.

I found out in us labor website then my wife is really qualify about job experience. the consular officer didn t think so, that`s why she did ask for the associate degree.

my wife did bring a proof of 2 years experience as sales agent for computer product and 1 year of experience as a customer service representative for telephone service in a call center. but the consular officer said that she didn`t found both experience as listed qualify experiences. It wasn`t true because we do.

I think my wife as a principal is qualify for both job experiences and education. Even she did not succed for state high school exam, she was selected for associate program in a college then she succed. she did bring the diploma at consular on 6th June 2006. from this day we still waiting.

My question is : should I tell them about this or wait for investigation to be done.
