dv-2006 confused

I am a diversity lottery winner and I am planning to apply for the Adjustment of Status, NOT the consular processing.
I found all that different information on different websites and I am so confused now.

1) What forms do I need to Kentucky Consular Center?

(some websites say that if person plans to apply for the AOS, he needs to send only DSP-122, some websites say that person needs to send DSP-122, DS-230 part1 and part2, when I called KCC they told me that I need to send DSP-122, DS-230 part1 and part2).

2) As I understand that when I send some forms to the KCC, they will send me a receipt or letter (I am not sure) and then I have to wait untill my visa number becomes avalaible. At that time I need to send I-485 to USCIS and I have to attach that receipt from the KCC. Is that correct?

3) May be somebody who went successfully through the AOS can tell me what their steps were?



I just dont want to do any mistakes, and I want KCC to realize that I am planning to apply for the for the Adjustment of Status, NOT the consular processing.

We are also a dv2006 winner and opted for AOS. We filled out and sent to KCC all forms that we received in our package: forms DSP-122, DS-230 part I and II (part II unsigned as per their instructions).

The congratulations letter states:

“Please read and follow all the enclosed instructions very carefully. ALL FORMS AND CORRESPONDENCE must be sent to Kentucky Consular Center at the above address. PLEASE COMPLETE AND RETURN FORMS 230 PART I, 230 PART II, AND DSP-122 FOR YOURSELF AND FORMS 230 PART I AND 230 PART II FOR ALL ACOMPANYING FAMILY MEMBERS TO THE KCC…”

Therefore, we did exactly this.

Your number 2 doubt is also ours. We would like to know:

1) Will we receive confirmation from KCC acknowledging receipt of the forms?
2) From this point ahead, will KCC schedule an interview when our visa number becomes current? Can we send form I-485 to KCC without waiting for this appointment?

If somebody already went through this, please help us.

This is want I know as far from reading information on different sites, talking to my lawyer and USCIS officer:


My lawyer called KCC twice. Second time it looked like he got somebody that knew more about the process. So according to hem if a person wants to adjust status with USCIS, they need to send only DSP-122. If you look at DS-230 and compare it with I-485 and G-325 (forms that you will have to submit for the AOS), it asks almost exactly the same questions. So there is no point in sending DS-230.

Search in this chart room, there was one posting and people were saying the sent only one form to KCC, they sent it and everything was ok, they received reply from them saying that they understand that that person will be doing AOS.

1) What I know from talking to immigration officer in the local USCIS is that KCC will send a letter or receipt and that I will have attach it when I send all application material for the AOS to USCIS.

2) As far as I know you will not have to deal with KCC anymore after you send initial information to them and they send you a receipt. You will have to file I-485 to USCIS when you visa number becomes current. Exact USCIS address varies depending on in which state you live.
KCC schedules apointments for people who go through the consular processing, not for people who do AOS.

Regarding the documentation, my husband talked to an immigration officer and he gave him a list of documents that must be submitted with the AOS application:

Diversity Immigrants (visa lottery) must submit:

1) I-485, Application to Register Permanent Residence or to Adjust
Status;
2) Proof of high school graduation or equivalent;
3) G-325A, Biographic Information;
4) I-693, Medical Examination of Aliens Seeking Adjustment of Status;
5) IRS-9003, Additional questions to be completed by all applicants for
permanent residence in the United States;
6) WR-703, Processing Sheet;
7) WR-770 (SNJ) 2211, Memo to National Visa Center.

In addition to the required forms above, you may also submit the following forms:

1) I-485 Supplement A, Application to Register Permanent Residence
or to Adjust Status for 245(i) applicants;
2) G-28, Notice of Entry of Appearance as Attorney or Representative
(if you have a lawyer);
3) I-765, Application for Employment Authorization and I-765
Signature Card, if you want to work while your application is
processed.
4) I-131, Application for Travel Document, if you need to travel
outside the United States while your application is processed;
5) I-485 Supplement A, and penalty feed if applicable. See 8 CRF
245.10;
6) I-601, Application for Waiver of Grounds of Excludability, if
applicable.


Regarding the address, I’m still confused about where to send these documents: Chicago or to a local agency? There is a USCIS news release from March 2005 (see: http://uscis.gov/graphics/publicaffairs/newsrels/20050330directmail.pdf ) that says I-485 applications should be sent to Chicago but it refers specifically to family-based applications for AOS (Form I-485). So, I think it applies to family-based applications only… Does anyone have any idea to where should we send our application? If somebody sent his/her application recently, please help us clarify this doubt. Thank you all.

Is this something that KCC sends to a person after he/she sends DSP-122?
