Dear Sir,
I won the Dv-2005 lottery. I applied for AOS and EAD on 10/10/04,and I received receipt notice. On 11/09/04 I received a notice from INS saying that my application is denied for the following reasons.
(a)Section 245 of the Act provides in pertinent part (they quote the law)
(b)At the time of filing, a visa number was not immediately available to you. Your number was not current in the month of filing or the month after. Any EAD you may have received is hereby terminated.
Please answer the following questions.
(a)When my number made available, can I re-apply?
(b)Do I have to pay new fees?
(c)Can I still qualify for an EAD?
(d)I am out of status, will that affect my EAD.
