During EAD/I-140/I485 Application

Hello,

I am currently on H-1B which expires in January 2004. I have received labor certification for greencard and my applications to BCIS (I-140 and I-485) are submitted. I have also applied for EAD based on greencard application. The question that I have is that do I need to renew my H1-B or can I just work on EAD until my application has been approved by BCIS. I am assuming that I will get EAD before H-1B expires and then I will renew it as long as I don't receive the greencard. I will also be travelling outside US during this time. Please Help! Thanks.
 
U can use EAD in the place of ur H1.
But, if u use EAD u need to apply for AP to travel abroad.

If u are not married and plan to bring ur spouse after getting married, u need to manintain ur H1 status.

Some say that it is good to maintain ur H1 status - as a back-up -in case something goes wrong with ur green card procedure.
