I am working in USA on L1B since July 7th 2002 and went on vaccation to India twice for a period of 3 months. My petition started on June 11 2002 and i will be completing 5 years in June 11 2007. My understanding is i can stay in US on L1 B for maximum of 5 years and I have to stay 1 year outside the country to apply for L1 B again. I have 2 questions.
1. Will the 1 year include the 3 months as well since i was out of US for 3 months during my 5 years stay in USA?
2.If i apply for an H1 B this year, for how long will my petition be valid? Will it be for 3 years or just 1 year(max stay on L1B+H1B being 6 years) or it will be 1 years 3 months(since i was outside US for 3 months during my 5 years stay on L1B)?
