Duplicate Labor Certifications

Dear Friends,

I just heard from my attorney that San Fransisco region stopped accepting duplicate lablor certifications and as a matter of fact SF is not going to accept any duplicate labor certifications at all!!

My 6 year period is ending this Nov 2003 so just to get 7 th year extension,my employer filed a NON RIR Labor on Oct 2002.
My RIR Labor is going to be filed tomorrow! after sincere recruitment effort for last 6 months

The plan was to get extension based on my NON RIR petition and
with draw the petition as soon as my RIR gets approved.

My attorney said that now its not possible because of this new law(?) -- duplicate labor is not possible.

Any body heard of this yet?

It's not a new law. It was never allowed to file a duplicate LC for the same person, same position, same forksite and in same SESA.

You can file to another SESA though (assuming there's' legal bases for this). I don't think that has changed.
