Hello,
I am wondering if i can get any kind of help or advises. I was in DUI 2 days before (criminal misdemeanor with .08 BAC), was arrested and they got FP's in jail . Below are my issues.

01)I have applied for I-140 2 months before, would there be any problem ?
02) I have applied for H1-extension (6 years to be completed) 1 month before, would my H1 extension be a problem ?
03) If i want to get a visa revalidation in USA, would they do it here or any issues ?
04) Any problems for the dependent visas ?
05) How about I-485, i am still waiting to apply for 485, should i fill in that i was arrested.
06) Should i inform my current employer ?
07) What should i ask the lawyer ie should i contest and try for reducing the punishment or should i plead guilty.
08) Any tips dealing with the lawyers.

I am really in big trouble, please anybody help me with any information or any contacts. I live in southern california.

disclosure at i-485 time eseential

tell them u got a dui pay fine,do coomunity serivce,and
get the driving classes compleytion certificate. do whatever the judger and your attorney agree to.

while applying for i-485 disclose this fully inclusing all court records

if first non violent non injury offense you are okay since 212(a) of ina does not make you ineligible

write a detailled statement inlcuding which ever sections they chareged you with from court sheet.

NOTE: after one year from conviction date apply for probation removal by meeting judge no need for attorney for this take proof of payment and proof that all terms are completed.

judge will order probabation removal.

immiadetely apply for record clearance and save all the papers.,attach these to i-485 application along with your statement and legal opinion saying 212(a) does not make you inelgible since it was not a crime of moral turpitide and neither was max sentnece more than one year
 
dealing with lawyer

1. flat fee for service ususally lawyer can get a better deal from judge in terms of community service. no fine reduction is possible but lawyer can get payment terms like 50$ a monht

this will cost u 5k total by the time u are done


try to reduce community service to bare minimim that is worth paying the lawyer.


get a legal letter from your lawyer explaining facts and stating that 212(a) does not render you ineligible for revalidaiton or adjustmnet of status
 
no need to involve employer

a dui is your business not employers. unless u are driving a truck or soemthing related to driving with your work,i dont think he needs to know about your personal drinking and or other habits

all info is just advice.i am not a lawyer so this is just my opinion
 
Don't drive under influence! I know this forum is not about anythying other than GC, but DUI is WAY TOO irresponsible!
