Need help with ds-156 form (L1B Visa), section 38, question no. 1 that says:
"Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty or other similar legal action? Have you ever unlawfully distributed or sold a controlled substance(drug), or been a prostitute or procurer for prostitutes?"
Here is my story:
In Aug-2006, I was charged with DUI (First DUI offense), was asked to appear in the court where I pled - 'not guilty'. Hired an Attorney and the case was lowered down to - "Reckless Operation".
Paid all the fines, My License was revoked for 6 months and I had to attend 72 hours DIP (Driver Intervention Program), which I did.
Everything was cleared and case closed.
Now I am reapplying for my L1B visa (as first got expired) and I am not completely sure whether to say 'Yes' or 'No' for above stated question on form ds-156.
I have gone through couple of similar cases on this forum and it seems the answer to this question should be a 'Yes' for a DUI conviction but in my case I was charged with DUI but not convicted for it and the case was lowered down to - "Reckless Operation", so does this also falls under the same category and I should be saying a 'Yes'?
Please help on this and also advise what all documents are required related to this that I should be carrying with me on the day of Visa Interview.
