DUI/Green Card--Advise needed please

Hi,

I am living in USA on a student visa. and I am convicted with DUI. I
was planning to apply for Green card next year based on my marriage
with US citizen.

Now i am confused and stressed that can I still apply for the Green
Card or not?

I would really appreciate if someone could help me with this.

DUI and Immigration

Definitely talk to an immigration attorney. A good one with offices near your local immigration office (where your case will finally end up). It depends on what kind of crime you were conviceted of. If the DUI was classified as a misdemeanor and that is your only offence, you should be fine. But if it was classified as a felony you will be in big trouble and face possible deportation. Even if it was a misdemeanor and the possible penalty (not necessarlily what the sentence was) is more than 6 months in Jail, you may face deportation. So do talk to an attorney and definitely do not try to apply for change of status by yourself.
