DUI - 485 Processing - TENSED - PLEASE HELP

Just got a DUI after applieng I-485. Will this effect my GC and my wifes GC processing. Should I inform INS about it now. Never had any prior offences. Very Tensed. Please help me
 
My thoughts

These are just my thoughts and is not a legal or any other form of advise.

1. At the time of application, on the day you signed and dated the 485 application you did not have a violation. So you are not hiding any material information - So, I think, you are okay. You do not need to volunteer any information.

2. At anytime after your violation the question is asked, you should not hide the facts - so, be it an interview with INS or any other application. You may also have to prove that the violation occured after the disclosure on the application.

Again, these are barely my views and not any legal advise. Please contact an attorney for any clarification.
 
DUI - Material ?

I was told by Greg Sisikind , DUI may not be Material Information at all,since it is not a excludable offense.

But I would really suggest talk to ur attorney and goahead and disclose it. Although not volenteering the information doesn't constitute any misrepresentation.

I would suggest , if u want avoid any RFE in future goahead and disclose it , becuase I'bet u may not have been fingerprinted anyway , and the FP may reveal ur DUI and so does the confusion.

Disclosing it to INS will put u in a Better half, than wasting time on ur RFE .

But either the way u r FINE. So ease the Tension ..
