Dual citizen returning "home": Can my child leave the USA with an expired US passport?

Hi there,

We're dual citizens planning to exit the US in two weeks. My little child's US passport has expired. Can she exit the US using her other country's passport, which is still valid? Of course we're in the process of renewing her US passport but it's not looking like it'll make it back in time. Thanks!
 
The US has no exit checks, so nobody will stop her from leaving the US as long as she has the documents to enter the destination country. The airline only cares about the documents to enter the destination country.

It is technically "unlawful" for a US citizen to enter or leave the US without "bearing" a US passport, but there is no penalty or other consequences for violating this law.
 
Newacct, thank you for the peace of mind. Sorry a little ocd, so should our entire family try to exit using our other country's passports? Would it raise a problem if everyone else used a US passport to exit except the kid?

There's nothing wrong with the child using a foreign passport and everyone else using a US passport per se. You don't really exit "using" any passport since there are no exit checks.

If the child's passport shows that the birth place is the US, the airline at check in might question why they are not using a US passport.
 
Thanks alot, this is a huge load off of my mind. Apparently renewing a US passport 14 weeks in advance isn't early enough...
