DS230-partII question

Hi,

I have a simple question w r t DS230-Part-II form as received in packet-4. In item#29, whose name should I write as a petitioner? Is it the company that I work for or myself? What should be the petitionar\'s name for wife\'s DS230 form?

Thanks,
Bhaskar...

Did you receive DS230 or OF230 in your packet 4 from consulate? Which consulate by the way?

how about spouse

Is it always the primary applicant\'s name for spouse and kids as well or it should be their respective names as petitioners

Petitioner name depends on your IV case

If immigrant visa is being processed by your employer then petitioner name must be employer name (same for spouse/kids as well).
Basically the person/entity who filed labor/I-140 on your behalf is the petitioner and you(including spouse/kids) are the beneficiary.
My humble opinion

some one else done with process please respond

we are getting different opinions. can some body who has already gone through process of filing/approval of packet 3 please respond

Person receiving GC is Beneficiary

This is for certain:

Beneficiary = Person(s) as in family members who will receive GC
Primary Beneficiary = Employee (for empl\'t. related application)

Petitioner = Employer (for empl\'t. related application) to be represented by company\'s name

[for example: also Petitioner = Brother (for family related application) to be represented by Brother\'s name, i.e. name of person who petitions the US Govt., generally through an attorney, but not necessarily, for issuing a Permanent Visa or other Visa for another individual, known as beneficiary.]

Additional Confusion

While I agree for the above explaination, I was told by my attorney that it should be your own name instead of the employer! As she said, the atcual petitioner i.e. the employer comes into picture only during IInd stage i.e. I-140 and for the CP, it just yourself(employee) and the Consulate. But I, too, don\'t agree with this explaination as I don\'t feel my attorney that much trustworthy! Manytimes she just guesses instead of giving any solid answers.

So, any CP\'ers comment about this (especially who have gone thr this)?

bbhasker,
I am planning on applying I-824. How long did it take for you to get the reciept back? NSC?
I am planning AC 140? did you finally go for AC 140? Can you please share your experience?
Thanks in advance.

I had my CP done in Chennai on the 21st of January and I put in my employer's name as petitioner.
