DS-156 Q36 : Is it safe to mention yes for Immigrant Petition filed?? Please help

I am going for h1 visa stamping in New Delhi. My 140/485 is pending. What should I mention for this Q in DS-156 form.

36. Has Anyone Ever Filed an Immigrant Visa Petition on Your Behalf?

Is there any issue if I say 'yes'.

Since it's been filed you probably have to say yes. Whether that will affect your application depends. I believe i said yes to that when i went to Canada to renew my F1 and also when i applied for my H1. My younger siblings must also have said yes when they applied for their F1. I think it all depends, so there's probably not one answer.

2 simple things ...

(1) You should always be truthful in any official forms -- that way something stupid won't bite ur ass later

(2) In this case, its a no-brainer ... H visas allow for DUAL INTENT ... so BY LAW, having an immigrant intent is NOT a valid reason for denying a H visa.
So don't worry ... just say YES as it would not have a negative impact at all
 
I too will be going for stamping and have some questions about the form DS-156. I know some may be really stupid, however I want to get it right.
Q15,16 For Home address, do you put in Indian address or US address?
Q25 asks for Name, etc for Persons in US who you'll be staying with --I'm assuming that I can put my wifes name for that?
Q26 asks how long do u intend to stay in US ??? Do I put in my H1 validity dates ?
Q27 asks Purpose of trip -- can i just put in business or work
Q29 Have you ever been in US .. when and how long? - I came in as F1 in 1997 and then am on H1 status, thus can I put in -- "since 1997"

26- Yes
27- Work (H1B)
29- I generally put mutiple years...Like F1-Yr, H1- Yr. Your choice
