driving license documents when 485 pending

I am applying for drivers license in virginia and have a learners permit issued before 2001 sep. Sincle my 485 is pending and even I-94 of H4 is also expired I am having a problem in submitting my doccuments. I would like to know if I submit EAD as primary documment what are the options for the second photo ID and also for legal presence. What is the INS form 797?

Your passport can be your 2nd photo ID.
To establish your legal presense, you should show your I-485 receipt and EAD card (if you have AP, you can take them too).
I-797 is Notice Of Action (for example your H1B approval notice).
