Driver License Cancelled with H1 expiration

My first 3 yr H1 expired on Septemeber 30, 2007. My attorney has applied for my H1 visa extension but we haven't received the receipt yet. Since my visa has expired, DMV has cancelled my Driver's License. DMV is saying that they need a proof of legal residence and the receipt will work.

My attorney think that my receipt must have been lost in the mail as we already received receipt for my wife's petition which was applied at the same time as mine. Need urgent help/suggestions.

When was your H-1B extension filed? If it seems truly lost in the mail, you can call USCIS customer service and ask for reissuing one, explaining that you need it to renew your driver's license.

If it doesn't work, the only option you have is to file premium processing and get an approval notice fast.

You are fortunate. In my state they never accept a Receipt Notice to renew the license, only Approval Notice.
