Hello All
I've been reading other threads to shed light on my doubts and find no similar situation. So I'm posting my question on some "required documents" as a new thread.
I'm a USC and my husband's Italian. We've been married for 3 years and 4 months and living in Italy all the time. This year we decided to move to NY to be closer to my side of the family and further our creative jobs.
We started the consular processing around April 2012 through the US Embassy in Italy. We had our approved petition in about 2 months and a half.
While we got our documents together for the interview we decided to get a head start and get an apt in NY and so we found one and already have a lease.
He already went to the final interview on the 9th October 2012 at the US Consulate in Naples. I couldn't go with him for work reasons.
Unfortunately, they denied him the visa and told him because some documents were incorrect/missing. I'm re-writing exactly the ticked boxes of "The Foreign Service of the USA Refusal Worksheet" they gave him.
X Section 221(g) which prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the Immigration and Nationality Act or regulations issued pursuant thereto. The following remarks apply in your case*
Pet is missing proof domicile, needed to sponsor and pet. Missing I864A and proof of citizenship from JS MOH.
X Section 212(a)(4) which prohibits the issuance of a visa to anyone likely to become a public charge.
We're filing a joint sponsorship with my dad and evidently filled in the incorrect form, but still turned in his latest tax returns, etc. So refilling the other form is not a problem, nor getting his birth certificate.
My doubts are
- They told him to get as many documents as he could get but, what other specific documents could work to prove my domicile? I'm self-employed so can't show a job contract. I only have the lease, one gas bill, an internet bill and proof that I opened a bank account. I'm also working on getting my state driver's license as well. I just moved in the apartment beginning Sept. so it's kinda hard to give more proof as well.
- As I stated before, we just recently leased an apartment and co-signed the contract. Does him having co-signing it compromise in any way his next interview?
- I'm worried about the second X, does it mean that since we didn't fill out the I864A form, this automatically comes into play? Or does it mean that my father alone couldn't serve as a joint sponsor?
I'm sorry for the long post. I imagine the more information I give the better picture you have of the situation. I also tried calling the USCIS offices in NY to clear my doubts regarding the "proof of domicile" documents but just forwarded me to the US Embassy. So no help there.
I hope though someone can help clear any of my doubts. I will truly, truly appreciate.
