Doubts regarding unemplyed sponser

Hi

I am the petitioner for my husband.Since I havent worked for past 2 yrs(2008,2009),but have worked for one month hardly the year before that(2007 dec to 2008 jan),and did not file for tax return because I returned to India to stay with my family (though I return to US every year to maintain my domicile).., will I have to show tax filing forms of those yrs along wth AOS I -864 ? I have a joint sponser to sponser my husband . Will his tax forms be sufficient or am i required to show it too??

Do i have to file 1040a and show zero tax returns in it and send along with I-864? Do i have to enclose a letter stating I was unemployed ?

Also while sending the AOS I -864,do the sponser have to be present in US? Because presently I 'm with my family in India. I used to have a Bank account in US,which proves my domicile in US,but recently it got frozen due to inactivity.Does having a US citizen child add to proving domicile? My son was born there.

Is it that the petitioner's AOS I-864 should be mailed to NVC and joint sponser's I-864 should be mailed directly to the applicant?

Currently my husband is in India.So from where all shoud the Police Clearance Certificate be obtained? Is it from passport office and local police of present residence or permenant residence, because both are different states?

If you are a US citizen, why are you worried about proving domicile? You can live anywhere but must file taxes on worldwide income. Failing to file is an issue.

If you are LPR, you may have lost your residency since you yourself admit you are not residing in the US.

To sponsor, you need to be in the US AND meet the income requirements. You appear to have many problems both with your own status if a LPR and you ability to sponsor your husband. Your USC child is of no benefit to you until age 21 if you are not a citizen; the child does not prove you are maintaining legal residency.


You need to get yourself back to the US and get a job before doing anything else. You need an attorney to walk you through the process since you appear to not have adequate income or resources to sponsor and if you are only a LPR, you have real issues yourself.
 
Yes.I am planning to go in the coming month.and do all the necessary to prove a domicile,like opening a bank account,renting a house and enrolling my child in school.

i HAVE A doubt of where should the joint sponsor's I-864 be send to? to the NVC along with my I-864 or directly to the applicant?
 
You realize you can be denied entry and have your GC revoked if the officer at the border determines that you have abandoned it by your extended absence.

If you are not a US citizen, the need for I-864 and eligibility for AOS may be years away. How long ago did you file the I-130?
