Double Nationality , Married but separated in 1 Country / U.S citizen boyfriend wants to marry me

Hello everyone , This a topic I have no idea how it works.

I was born in southamerica and Im married but currently separated trying to get my divorce. Since the Laws in my country are very difficult Its not easy to get an divorce. Acutally I have a WVP passport and I do have an U.S Citizen that is waiting for me to go back to USA and get married. The issue Is I told him Im still legally married in my country , so he said why not traveling to Usa using my WVP wich I didnt use to travel to use long long years ago and marry him under that nationality wich in my european country Im not married? Im not sure about that if can be posible or dont I dont want to get into to trouble , the issue with my current southamerican marriage is my ex was reported by me to the police station several times for psicological violence and that is now gooign to the whole process at the court to determine the sentence. The time can go from 3 to 4 years to get the divorce its a long way being myself in a risky position since my ex its a very violent person and possesive , currently is always following me and doing crazy things that the law does not protect me here.

The Issue with that can help me in this case? How to marry a an US citizen if still married? Married but in danger? Im dont see how to get out of this but I need to clarify this so I can tell him if we or we cant get married in a shorter period.
Like I have said I was married in South America but planning to travel to US with my european nationality how can work that?

You are committing adultery and now proposing committing immigration fraud by becoming a bigamist. I don't know what to say other than: "Don't do what you are proposing!!!"

Get yourself to an attorney for a full explaination of the consequences.
 
Im not an adultery , Im separated from the men I married long time ago , but Im still married legally and this person its a psicophat. Anyway I was only asking what my boyfriend told me but I dont see the point I just want to ask someone else more into the laws. I also have heard about getting a divorce in the states for example the state of Fl grants you a divorc even if the other party its no there even if you are not married in the florida , thats why we are seeking anwsers beacuse we are confused with many people teling us different stuff.
 
You are still legally married!!!!! That is adultery. Given a family member of mine was deceived by a woman in a situation similar to yours, you need more help than I have patience for.

You need to consult a family law attorney if you have an established residency in a state for the required length of time to qualify for divorce proceedings. Divorce without the other party present can be difficult and is not a do it yourself project. When you add the international issues, it will be neither fast nor cheap.
 
You must divorce before you marry again, or your green card will be rejected.

But if divorcing in your South American country will take years, it is possible to divorce in another country in a shorter time. If the divorce is recognized by the US you can then marry and immigrate to the US (whether the divorce is recognized by the US is a complex issue - but generally if it's done in a US state it will be recognized).

Don't plan to use the VWP to enter the US and immigrate; courts are clamping down on VWP travelers who do that.
