I wanted to ask on double filing of i-485 and a job change issue. As a background, my case green card AOS was recently filed under July 2007 AOS category (with my wife applying as a secondary applicant). My case already has approved PERM labor (Design Engineer, PD = 06/2006) and an approved I-140 under EB-2 category (I-140 receipt date = 07/2006; Approval Notice date = 01/2007).
1) Given the timeline/possible retrogression in EB-2 category, my wife is planning to file for green card in EB-1 category through her employer (with me as a secondary applicant). How does this affect our AOS that has been filed by my current employer? Is it possible to keep two applications? When do we have to finally decide which one (out of two) do we want to keep?
2) If my wife doesn’t apply in EB-1 and we go through my EB-2 AOS application with my current employer, what happens if (2 scenarios):
a) I change my job description within my current company (e.g. going from design engineer to a marketing manager or a business related role)? Can I keep my Labor/I-140 priority date? How will this affect my green card process if I change it before AOS has been pending 180 days? What if AOS has been pending more than 180 days?
b) I change the company AND the job description (e.g. going to a different company AND changing the job description from design engineer to a marketing manager or a business related role)? How will this affect my green card process if I change it before AOS has been pending 180 days? What if AOS has been pending more than 180 days? Other issues?
