EB3,PD->7/97,ND->Jan/2000, FP->2/2001 These are my deatils, I have not recieved FP notice for my spouse, also I have not applied for 2nd EAD, as my spouse is having a H1, I am on H4. I am a primary applicant.
Please suggest me what should I do?

Thanks for your suggestion, but I have not used first EAD also, I am maintainig my leagal status, lawyer said me no problem?

Please tell me? is it not possible to get GC on H4.

Maintaining legal status is not enough if you are the primary applicant. From what your lawyer says, it looks like you are a
derivative of primary applicant.
You can get GC on H4 if you are a derivative apllicant.

Theoretically this is not a problem since GC is for a future job. So, as long as the sponsoring company certifies that they\'ll hire you once GC is approved, INS may not deny your petition.

Practically, however, you may have some explaining to do as to why now, even though you have EAD, the same company is not hiring you.

Thanks for you suggestion, I have a small baby 1 3/4 years old, is this is answer I can give as this is very true, I did not work because it s very difficult to take care of a babby.

The INS may ask that if you can\'t work now because you need to care for the baby then how will you work after the GC approval, i.e., how will conditions change with approval.

Please consult a good lawyer.

A derivative is a dependent of the primary GC holder - like a spouse or children.

OK I understand, Thanks for your kind suggestion, do you have any idea, like how much my case may take to get approved. Also my spouse did not got any FP notice so far. Sorry for trouble but I need these info as I can prepare myself.
